    Railroaders work, and expect to be paid. It's a simple idea. Less work means less pay. Likewise, more work should mean more pay, but that's not the way things work on the CSX. According to union contracts, there are situations that warrant additional pay, for additional work, but more often than not, these claims are not honored by the CSX.

and I don't work on a violation of our union agreement. Not giving one
minute extra of my time. You will just have to roster call until your
fingers bleed. Sorry, not your fault. Blame it on the lying management
that blows smoke up our arss and promises the tickets you have a right
to then don't et them. Blame it on labor relations and the stealing
they do every single day. You have to take the brunt of their unethical

CSX cuts 86 from managerial ranks
CSX cut 86 jobs — mostly at its Jacksonville, Fla., headquarters — last
week as part of management realignment, the Jacksonville Daily Record
reports. The railroad told the newspaper in a statement: “The changes
followed a careful review of our management organization that
considered what work we should be focused on and whether that work
resides in the right place in the organization … The synergies achieved
through these realignments unfortunately resulted in the reduction of
some management positions across the company.”

Intermodal firm backs CSX, CN request to change conditions of Massena
Line sale
An intermodal shipping firm has told the Surface Transportation Board
it supports the request by CSX Transportation and Canadian National to
reconsider conditions to the sale of CSX’s Massena Line to CN. In a
June 16 filing, Atlantic Container Line’s vice president of logistics,
Brian McBride, says the proposed sale could reduce transit times for
shipments by 24 hours. “We are concerned that these anticipated
benefits will not be achieved if the transaction is not able to move
forward,” he writes. The line sale, which has already been approved by
the STB, is in limbo because the board ordered the elimination of a
provision which would bar CN from negotiating direct interchange with
the Finger Lakes Railway and the New York, Susquehanna & Western in the
Syracuse area. [see “Railroads say sale of CSX Massena Line to CN may
fall through,” Trains News Wire, May 29, 2020.] Interchange with those
railroads could cut CSX interchange business from CN.
Ottawa transit chief doubtful light rail issues will be fixed this
As Ottawa prepares for another maintenance shutdown of its troubled
Confederation Line light rail, the head of the transit agency in
Canada’s capital city expressed doubt the system’s builder can fix the
line’s problems this summer. Global News reports that John Manconi,
general manager of OC Transpo, told the city’s transit commission that
he is “not confident” the Rideau Transit Group will meet an Aug. 31
deadline, because it has not agreed to that date or any other to
complete the work. A software update has addressed problems with the
doors on the light rail vehicles, but other outstanding problems
involve control systems, rails, and catenary. The line is set for full
or partial shutdowns June 21-24 for more work.

if you got supervisors doing your work that is a 5 DAY PENALTY CLAIM! 
It goes straight to the Internationals office. I had those paid in the
past and the TM got his ass handed to him. Poster is right. You have to
put these claims in. Like the CN guys have kept saying on here, this is
a CN attitude that was bred in by HH and you got to nip it it the ass
now. DONT ANSWER ROSTER CALLS!  They can call all the people back. The
coronavirus scam is over. It never was an issue on the railroads. We
are essential. No one wears mask or gloves and the railroaders were not
going home sick with the shit.  They can call people back. They are
using it for a scam to keep people off. The business is back. This is
why they cant run damn trains. They know the freight is coming back but
they want to keep people off.
 I got to wonder if they don't have their hands in the FEDS pockets
getting $$$$$ to help them out with their operating losses because we
are part of the USDOT and commerce freight. I wouldn't be the least
bit surprised. The FEDS will catch on soon! In the meantime, I sure the
hell ain't doing anything extra for them and I sure ain't answering
those damn roster calls, I wont anyway. Too damn tired from being woke
up all damn night from the phone wringing. Besides, they screwed me
over for the last time last week and stole over 500.00 bucks from me.
I'm not hired to work for free or be screwed out of what CSX signed
their signature and agreed upon. Biggest liars and con artist I ever
worked for.

U.S. rail unions have united in an effort to overturn the sequestration
of Railroad Unemployment Insurance Act (RUIA) benefits that was enacted
by a GOP-held Congress during the Obama administration and continues to
reduce the unemployment and sickness benefits of railroaders nearly a
decade later.

A large bloc of the unions are represented by AFL-CIO’s Transportation
Trades Department (TTD), of which the SMART Transportation Division is
a member.

A letter to U.S. Sens. Rob Portman and Sherrod Brown of Ohio sent by
the union coalition requested that they jointly co-sponsor language
consistent with the HEROES Act (H.R. 6800) to eliminate RUIA benefits
from sequestration by amending the Balanced Budget and Emergency
Deficit Control Act of 1985 to include RUIA among the other various
programs that are not subject to sequestration. Portman, a Republican
out of Cincinnati, is chairman of the Senate subcommittee that will
make a decision on sequestration.

“Unlike the average U.S. worker, railroad employees do not receive
unemployment benefits through state-administered unemployment insurance
programs. Instead, unemployed railroaders receive these benefits through
the RUIA program, which is administered by the United States Railroad
Retirement Board (RRB),” TTD President Larry Willis said. “As a result
of the Budget Control Act of 2011, RUIA (benefits) are subject to
sequestration. No state unemployment insurance benefits in the country
are subject to this unfair treatment.”

RUIA unemployment and sickness benefits are sequestered at 5.9%, and
have been subject to reduction for nine years. These rates are adjusted
when the federal sequestration is recalculated yearly.

Railroaders are urged to call Portman at (202) 224-3353 to tell him to
exclude RRB sickness and unemployment benefits from those reductions.

To help combat the spread of misinformation concerning the Investing in
a New Vision for the Environment and Surface Transportation (INVEST) in
America Act, Alternate National Legislative Director Jared Cassity has
provided the following facts regarding the two-person crew provision in
the bill.


The INVEST Act, as written, requires a certified locomotive engineer
and certified conductor on most freight trains. According to the bill,
there are instances that a train may be operated with a reduced crew.
Exceptions are listed below:

A freight train may be operated with a reduced crew, if:

The train operations are within a rail yard, terminal area, or on
auxiliary or industry track
It does not exceed a maximum speed of 25 mph on territory with an
average track grade of less than 2% for any segment of track that is at
least two continuous miles
The locomotives are performing assistance to a train that has incurred
mechanical failure or lacks the power to traverse difficult terrain,
including to or from the location where assistance is provided
The locomotives are not attached to any equipment (except a caboose)
and do not travel further than 30 miles from a rail yard
A location where one-person operations were being utilized one year
prior to the date of enactment of this bill, only if the DOT Secretary
determines that the operation achieves an equivalent level of safety
(Note: The Secretary of the DOT is appointed by the President of the
United States)

In addition to the above, a train may be operated with a reduced crew,

The carrier has fewer than 400,000 total employee work hours annually
and an annual revenue of less than $20,000,000

It is transporting one or more loaded cares carrying material toxic by
It is carrying 20 or more loaded tank cars of a Class 2 material or a
Class 3 flammable liquid in a continuous block
It has 35 or more loaded tank cars of a Class 2 material or a Class 3
flammable liquid throughout its consist
It is 7,500 feet in length or longer
The INVEST Act is poised to be the most significant piece of
rail-related legislation this generation of railroaders has seen since
the passage of the Federal Railroad Safety Act of 1970.

Living in the past

It was Hunter Harrison who said himself "Cultures are changed ONE
FUNERAL AT A TIME!"   Don't forget he said it!
If the brothers would stick together and file continuous claims for
every single violation even if they think it wont get paid, and start
paper trails it would show we mean business and it would show the
company is in willful violation. All you have to do is tell the
violator who is ordering you to violate the agreement, what he is
violating and if you can quote the article agreement. Let him tell you
he doesn't care. Let him blow smoke up your arss that he has too
because someone else is telling him he has too.  They love to blame
someone else every time you put the facts in their face.  Be cool about
it.  Then when you put your claim in your state that in your facts. Then
immediately write a statement out to your LC and have him send it to the
General Chairman. You have a right to notify the General Chairman's
office when you have an employer who is maliciously and deliberately
ordering you to violate a signed, sealed and agreed upon condition of
work and demand a complaint to be filed.
Then when they still deny the LEGIT claim you resubmit it with
information that will get their attention.  The poster that said his
friend told him to whistle blow is spot on. Its not love out here. They
don't play fair. They created all this mess. Problem is with this new
group of cry babies and ball less wonder, is they don't have the guts
to play hard ball. They are all scared to death. The balls of the old
heads never got passed down. Production and publicity is what makes the
railroad of today run.  Think about it. The competition was low 100
years ago. Now all railroads have to compete with trucking industries
and other railroads. They have to beg and advertise to investors and
customers.  They fight for grants and achievement awards to put
themselves out there in the lime light.
The worst thing for any railroad is bad publicity, The workers can have
them by the balls if they just do what all the rules say and get it out
there in paper trails and complaints that they are not playing fair and
violating the hell out of negotiated working terms.
You cant count on the Unions to do it. Especially the ones who are in
bed with them. You got to force their hands. The members have to start
the stink. Put the unions on the spot where they have to take action to
save their faces and their jobs.
It is just sad as hell that these new pups just don't get it and
don't have the balls or the family history that taught them to be a
man and fight for what you are entitled for. 
Like Hunter Harrison said...cultures change one funeral at a time. 
These ball less wonders need to get this shit straight and start
changing the so called new regimes culture. The railroad DOESNT RUN IF

OK...Here we go again. The company is once again playing their usual
game with denying claims.  This time they are going for the jugular. 

When working a road switcher job they forced us to come into the yard
and do a bunch of yard work and intermodal work while the yard crews
were on duty. We all know this is YW claim. 
Claim declined. REASON......The claimant has provided INSUFFICIENT
information to process the claim. The claimant has not provided a clear
and detailed explanation of the yard work performed. It is incumbent
upon the claimant to produce sufficient evidence to support the version
of facts upon which it relies.

So if you are forced to do yard work and they refuse to give you
another ticket for changing job classification then you have no way of
proving with paper exactly what you have done. We gave as much detail
about the work that we could without having work orders, etc.
I was advised as of yesterday by a legal friend to blow the whistle if
necessary . Explain there is no way to prove what you did if you were
not given anything in the way of paper that links you to any of the
work and then give names of all parties involved. TM, YM, other crews
as witnesses, any unusual events during the work and any radio messages
that can be pulled and reviewed to show you were working and on duty at
that particular time.  This is total crap that they deny claims in this
manner. How in the hell do you prove that you actually were working yard
jobs and switching out cuts, humping car, pulling cars, digging out bad
orders, hosteling power etc, if there is no paper trail to use.
Unfortunately it is time to play hard ball.  There is no one to blame
but labor relations if shit hits the fan. It aint going to be pretty.
Whistleblowing is the only alternative.
