RE: Threats, Intimidation & Harassment by CSX Officials and
Whistleblower Protection…URGENT INFORMATION!
Recently in the past few weeks, unethical and illegal actions by CSX
T&E Terminal Management in Newport News, VA have created a very
unsettling situation
that requires a legal response by the United Transportation Union local
6662 on behalf of its members performing service in the CSX Newport
News, VA Terminal.

PLEASE NOTIFY A UTU 662 OFFICER, LOCAL CHAIRMAN OR VICE LOCAL CHAIRMAN
ASAP IF YOU ARE BEING INTIMIDATED, HARRASSED OR THREATENED IN ANY WAY
TO PERFORM SERVICE THAT CONTRADICTS ANY OPERATING RULE, SAFETY
PROCEDURE OR FRA MANDATE. PLEASE MAKE NOTES OF THE INCIDENT AND HAVE
WITNESSES THAT CAN BACK UP YOUR STATEMENT.

There have been several incidents over the past few weeks in which CSX
T&E Employees working assignments in the Newport News Terminal were
instructed to perform illegal operating practices by CSX Management.
Several of our members were harassed, intimidated and threatened by CSX
Officials when the member questioned or challenged the instruction.

These incidents involved:

· T&E yard crews being instructed to assist other yard crews that are
not assigned as a Utility Person. You are reminded that you cannot
assist and attach yourself to another crew unless you are performing
service as a Utility Person per FRA & CSX Operating Rules.
· Other incidents involved had yard crews being instructed to drive CSX
company vehicles while on duty. While this is not illegal per the
operating rules, it is a violation of the UTU CSRA Agreement Article
28. If you are instructed to drive a CSX company vehicle while you are
on duty performing service, please notify CSX that you will drive the
vehicle as instructed but YOU ARE CLAIMING 1 DAY PENALTY per the CSRA
Agreement. Per the CSRA, only Utility Persons are authorized to drive
CSX company vehicles while on duty to perform Utility Service, not
regular Trainman Service such as RCO Crews or Conductor/Brakeman.
· ADDITIONALLY, IF YOU NEED A RIDE WHILE ON DUTY IN THE NEWPORT NEWS
YARD, PLEASE REQUEST A RIDE VIA THE YARDMASTER. Please make sure that
CSX Clerks or PTI Drivers are giving you the ride as it their job to do
so. Please do not use your own vehicle for on duty work on CSX
Property.
· Taking Breaks or demanding Meal Periods while on duty.

As a result of the culmination of the above mentioned transgressions,
on Wednesday March 7, 2012, CSX Management in Newport News, VA violated
Federal Law and the CSX Code of Ethics by removing, demolishing &
re-locating the UTU Office to a smaller room that is not secure proof.
This action is the result of retaliation by CSX Newport News Terminal
Management when UTU 662 Members who are CSX Employees reported rules
and ethics violations committed by CSX Terminal Management in Newport
News. Not only was the UTU Office moved without the Local’s permission,
the CSX Newport News Terminal Manager threatened to destroy and throw
away our property, files and documents that must be retained and kept
on file for federal regulatory compliance. Many of these files
contained several of our members personal and employment information
such as Social Security Numbers. The CSX Newport News Terminal Manager
threatened to throw all of these documents in the dumpster without
proper disposal or the UTU’s permission or notice thereof. This Office
is also shared by the BLET and TCU. Their possessions were also moved
without their permission or notice thereof.

These illegal and unethical actions by CSX Terminal Management in
Newport News, VA have been reported to the CSX Ethics Hotline, CSX
Division Management in Huntington, CSX Labor Relations in Jacksonville,
FRA, OSHA & US Department of Labor. The CSX Newport News Terminal
Manager was previously cited and charged for ethics and rules
violations by the FRA in 2006.
