Brothers 

Retired CN IS RIGHT! The union he was in had balls. We got nothing but
horse traders. Where are they? Where is the transparency? Why haven't
they sent out mass mailings of their actions and addressed the members?
 No where to be found. As for your employee records, look how hard they
have made it to get into your Observation testing records. You have to
jump through hoops now. So called extra security measures they claim.
Security FROM WHO! Who gives a shit about our obsevation testing scores
 accept the employee and his lawyer when he needs them. You have a right
by federal law to view your employee records. Everyone needs to demand a
copy of all files and entries made in your files. God knows what they
have written in them. If you were around in the last 25 years then you
should remember when they had a hit list out in each terminal naming
the employees who were to be stalked and monitored. They had a training
manual out in the southern region for supervisors detailing how to
identify and notify other supervisors when one of the Violators was on
their property. Was an insane course that got pulled after one of their
own squealed about it. These people are ruthless. If we can't count on
our unions we shouldn't be paying the ones we got. It's time to look
elsewhere. We have the  railroad labor act to back us on this one.
It's time to get serious! Turn in the FRICKIN CLAIMS BROTHERS! It's
the only way to hold the union's accountable
And start paper trails. If you don't know how to do a proper claim
call your LC. If he won't answer back or help you then call your
International. Call until someone steps up to the plate. We can't go
after them if we don't file claims and start paper trails. JUST DO IT
BROTHERS!

Our worst enemy is our own union. It’s like a guy watching his child
get abused and just stands there and looks the other way and does
nothing. That’s our union. I don’t blame the company they should be
trying to screw us that’s what they have always done. The union is
supposed to look out for us but yet they continue to turn the other
way.

Engineers in any class of road service may be required to perform two
or more classes of road service in a day or trip.

Paragraph E-THIS DOES NOT INVOLVE THE COMBINING OF ROAD WITH YARD
SERVICE NOR MODIFY OR SET ASIDE!

Every single engineer in Avon who is coming in off the road on thru
freight service is being forced to dog catch trains and they are being
told by the Superintendent that they can not get them paid on J job
tickets but they can on Y(yard)Job tickets. This is an outright lie.
They can but do not want to. They know that a J ticket for a thru
freight crew has to be a Local switcher ticket with a kind of service 4
and it can not be combined with any yard jobs. They are blowing this
smoke up everyone's arss because they are short in the yard and need
men to pull, hump and hostel cars. They are abusing the agreement in
numerous ways.  If you come in and they tell you this NOTIFY YOUR LOCAL
CHAIRMAN IMMEDIATELY. LEAVE A VOICE MAIL OR WHAT EVER BUT LET THEM KNOW.
 FILE A CLAIM FOR VIOLATION OF ARTICLE 50 AND MAKE SURE YOU DO NOT
FORGET TO NOTE PARAGRAPH E AND WHO TOLD YOU THEY COULD NOT GET YOU PAID
ON A J TICKET. ASK THEM WHO IS DENYING THE PAY AND WHO THEY ARE GETTING
THEIR INFORMATION FROM.

THE CALL WILL BE SPECIFIC AS TO WHAT SERVICE THE ENGINEER IS BEING
CALLED TO PERFORM  AS TO THE TRAIN NUMBER AND THE TIME TICKET WILL
REFLECT THE TRAIN NUMBER WITH AN "R" DESIGNATIONTO DENOTE RELIEF
SERVICE. IF IN EMERGENCY HE IS CALLED TO RELIEVE A SECOND TRAIN WITHIN
THE YARD/TERMINAL LIMITS HE WILL BE PAID THE PENALTY CLAIM AND WILL
RECEIVE A SEPERATE WORKING TIME TICKET FOR THE SECOND TRAIN.

AND REPORT THE PROBLEM.

ALL UNION MEMBERS


First:Conductor is 100% right.  The FRA and the Unions sat down
together and discussed the situation with the Coronavirus and the
decrease that was predicted in manpower and freight. They both agreed
that some of the hours of service rules could possibly be relaxed. They
did NOT agree on CSX violating the hell out of the agreements.

Second: Yes, freight went down as it has done every single year during
the down times. Everyone in the railroad industry knows that it is
feast or famine on the railroad. It has been that way since the
beginning. CSX took advantage of this so called deadly virus and used
it to cut manpower to a low that they have been doing for years anyway.
Anyone who has been in this industry 30 years or longer can remember how
many times during the winter the boards have been cut and XBD have been
cut down to 5 men or less. This is NOT UNUSUAL! It happens ALL THE
TIME! They are using a virus for an excuse to break agreement rules and
the Unions and the FRA are well aware it is nothing more than a way to
cut manpower and line their pockets! Stock is back and freight is back.
Yes, they are calling some back, but they are still raping and violating
the hell out of all agreements. NO EXCUSE FOR IT AT ANY TIME!  It is a
big farce and a big lie that they need to adjust anything for this
coronavirus.

Third: Railroaders did not fall out and die. Railroaders did not call
in sick from the virus in massive numbers like they predicted. They
have been working their butts off and if someone were sick they came in
anyway because they were/are scared of the insane discipline policy.
This is why the men who were furloughed and called back are taking the
entire time allotted to come back. They aren't coming back any sooner
than they need to. Why the hell would they. They know they are coming
back to a hell hole of management that is abusing their PAY,
agreements, jobs, home lives, and are in bed with the FRA and the
Unions. CSX is taking advantage of a situation that DID NOT HAPPEN!
The freight did not get any lower than it had in previous bad years and
no one gave them an excuse to rape the agreements. Low freight was
temporary and is now becoming a problem of the past. Freight is up!

Fourth: Hiring new CN management is no different than the years they
took on rejects from the NS. Unfortunately CN officials have a
different mind set than NS or for that matter, any US railroad. They
were trained my Hunter Harrison to ignore and destroy all union
agreements. They were taught to challenge the Federal Government and
ignore all Federal laws. They were taught they were above the law,
unions are bad and to divide and destroy. They were taught to union
bust. They will lie through their teeth with any excuse they can to
violate your agreement. As the previous poster stated, they will make
the excuse they don't know the agreement and then expect you to
believe this outright lie. They will say they are new to CSX and don't
understand. ANOTHER OUTRIGHT LIE!  They have connections and have the
same CSX Labor relations department and well as the same CSX legal
department at their every disposal who know the agreements and what is
Federal law in the UNITED STATES! We can not allow a corrupt Canadian
regime to come in and destroy our UNITED STATES Union Agreements that
we fought for so hard, nor can we allow any Union to represent us who
will bend over and horse trade and play with CSX, CN or the FRA. This
is the UNITED STATES and our railroad Unions and members are under
attack. If our Unions cant stand up and fight for us then they need to
be replaced with a union that stands proud and fights for it American
brothers. This is a war against American Union members!

It is time to clean house as stated. It is time to play hard ball. It
is time to do what needs to be done. Everyone needs to take this
seriously. Right now  is the time to set up your children's futures in
the railroad. Now it the time to take hold and make sure that all
generation of railroaders don't get RAILROADED! Blast the Union
legislative reps and Internationals with petition demanding the
protection of all United States union members. Demand and answer.
Demand and action plan for defend our nation of Union Members. It is
time to get serious. This is no joking matter. Turn your head at this
post and act like its not as bad as it seems. You are blind if you
think so or you really just don't care. Well, maybe you should be
considering this....YOU PAY $$$$$$ every single month to a Union who is
not playing ball with you and is going home with their pockets lined and
fishing in their new boats on the weekends!

Last week, the Committee on Transportation and Infrastructure approved
the rail provisions of the INVEST Act (H.R. 2). The legislation now
goes to the full House for a vote, including our key pieces of
legislation. This does not happen very often, but it is happening now.
On June 30th, the U.S. House of Representatives will be voting on
legislation that includes two-person crew.
 
This week is all hands on deck. We need every member, retiree and
family/friends to send a message to their Member of Congress and ask
them to support the rail provisions in the INVEST Act. On our Action

Now is the time to step back and watch their actions. As for the
company making a last minute show of concern for the employee and the
coronavirus, watch and take notes and pictures if you can do so without
being charged for a rule violation. Will they be 6 feet apart? will the
shake hands? You can not be 6 feet apart and shake hands. Will they
come in and demand everyone be 6 feet apart from each other while in
their Godly presence? Will they be sitting 6 feet apart from each other
in the passenger car? 

Pay close attention. Watch their actions and the words they use. Now is
the time to note all their activity. This is a show of force. As for

Just read that link.  The FAST ACT covers the law on your private
conversations. Not just a law for passenger service. That crew has
grounds for a law suit!  Their conversation should have never been
brought up. You can bet you won't find it in any recorded or written
transcripts. Time for this crap to hit the fan.

Read up brothers.  Not a judge in the world will side with the carrier
that mentioning that conversation wasn't only an intimidation tactic
but was against the law!

Legal

I had an RF tell me and some other guys that there is a sound recorder
in the nose of the locomotive that is linked to the black box to pick
up the sound of the horn. Some how goes with the video recorder filming
outside of the cab for proof that the horn was actually working. They
need it for proof if we hit someone. He said it couldn't pick up our
private conversations. This must be bull crap then. If they were able
to repeat the conversation they had then either the RF was lying or
they put a new voice recorder in with those new Sniffer cell detector
cameras. They are doing live feed of crews in the cab.  This is a fact.
 It isn't just viewing the download feed later. We had a crew that was
told to adhear to a petty minor rule they were violating while they
were stopped. Wasn't violating it while running. They could have only
seen it at that particular time. A TM told us he was actually ordered
to watch a live feed of a crew who was suspected of delaying their
assigned job on purpose. Jacksonville wanted their every move watched.
He admitted he could see everything with the camera and they did in
fact ZOOM in on cell phones and could see everything on the screen of
your PHONE! I don't make a call unless I connect where they can't see
it. My private numbers are none of their business. Shouldn't it be
illegal for them to bring up private conversations in the cab at a
discipline investigation? I don't give a rat's arss if we are in a
company owned locomotive or not. I have heard there have been many law
suits won where employers were secretly recording conversations of
workers and using that info for insider trading and
intimidation/harassment. Plus, if you say something about an official
they don't like it could influence the hearing! That's why a jury is
not allowed to hear or read or discuss any information about a case
outside of the court room. So how in the hell can CSX get away with
this invasion? Please let us know what you find out. We have a right to
know the truth! It is unfair as hell too if they hear your strategy for
winning a case or info you might have against an official. This is just
plain mafia style tactics. Everyone needs to be notified if this is
happening!

Train and Engine Employees

It has been brought to our attention that you might be working in a
locomotive with a voice recorder. During an investigation hearing a
conversation between the crew was brought to the table. Neither crew
member discussed  the contents of this conversation with anyone else.
The only conclusion could be is that the conversation was overheard in
the cab through voice recording. This will be investigated thoroughly.
Do not under any circumstance discuss any private information that you
do not want the carrier to hear. Do not discuss any health or medical
issues. Do not have a conversation on your phone you do not want
overheard. Do not discuss any union issues involving you or any other
member. This is an invasion of your privacy. You should be notified if
you are being voice recorded. Until this issue is rectified keep all
personal information to yourself.

Safety Joke


Every single day CSX violates EPA regulations. I can see the black
smoke rolling out of the locomotives.  I know for a fact they have fuel
leaks and leave silica sand on the ground. They spill their commodities
all along the railroad and I know some of it has been treated with
dangerous/hazardous chemicals. How do they get away with this. If a
truck driver is traveling on the highway and was spilling their loads,
they would be pulled off the road and most likely get a ticket. They go
by and you can clearly see oil dripping off of some of the motors.  I
also know that many have toilet water leaking out of them.  It is
amazing what the railroad gets away with. Then they run their crews
into the ground and harass the hell out of them to rush and work
unsafely.  Now that the summer heat is here, I got to wonder if they
are going to follow all state, county, OSHA, health and federal laws.
Will they allow there employees to take a 10 minute heat break. There
used to be a law on the books that employees were allowed a break for
10 minutes every hour.  Someone better research this and let the state
know if they aren't doing it. How about some air conditioning in those
steel ovens????

CSX cuts 86 from managerial ranks
CSX cut 86 jobs — mostly at its Jacksonville, Fla., headquarters — last
week as part of management realignment, the Jacksonville Daily Record
reports. The railroad told the newspaper in a statement: “The changes
followed a careful review of our management organization that
considered what work we should be focused on and whether that work
resides in the right place in the organization … The synergies achieved
through these realignments unfortunately resulted in the reduction of
some management positions across the company.”

Intermodal firm backs CSX, CN request to change conditions of Massena
Line sale
An intermodal shipping firm has told the Surface Transportation Board
it supports the request by CSX Transportation and Canadian National to
reconsider conditions to the sale of CSX’s Massena Line to CN. In a
June 16 filing, Atlantic Container Line’s vice president of logistics,
Brian McBride, says the proposed sale could reduce transit times for
shipments by 24 hours. “We are concerned that these anticipated
benefits will not be achieved if the transaction is not able to move
forward,” he writes. The line sale, which has already been approved by
the STB, is in limbo because the board ordered the elimination of a
provision which would bar CN from negotiating direct interchange with
the Finger Lakes Railway and the New York, Susquehanna & Western in the
Syracuse area. [see “Railroads say sale of CSX Massena Line to CN may
fall through,” Trains News Wire, May 29, 2020.] Interchange with those
railroads could cut CSX interchange business from CN.
Ottawa transit chief doubtful light rail issues will be fixed this
summer
As Ottawa prepares for another maintenance shutdown of its troubled
Confederation Line light rail, the head of the transit agency in
Canada’s capital city expressed doubt the system’s builder can fix the
line’s problems this summer. Global News reports that John Manconi,
general manager of OC Transpo, told the city’s transit commission that
he is “not confident” the Rideau Transit Group will meet an Aug. 31
deadline, because it has not agreed to that date or any other to
complete the work. A software update has addressed problems with the
doors on the light rail vehicles, but other outstanding problems
involve control systems, rails, and catenary. The line is set for full
or partial shutdowns June 21-24 for more work.

CSX LABOR RELATIONS!!!

I'm done with you. I'm done with your stupid games you play.  I'm
done with your denials that you know are damn good claims. So here is
what is happening. Many of us have had a meeting about it. This is all
going to go down because of you. Now, in your defense it is CSX
management that is creating the need to put in  a claim EVERY SINGLE
DAY for blatant disregard for our union agreement, but YOU are the 
ones who are denying them when you know they are good legit claims that
CSX signed and sealed their John Henry on. Because of your blatant
thievery and blatant disregard, especially when you of all people know
how union agreements work and what is a legal claim of VIOLATION, there
will be many charges of FRA, OSHA, State and Federal law and ethic
violation coming forward. They will be in writing and they will be
noted on many claims. Any activity that take place during the time of
forced violation will be noted and reported. You will be notified as
well as the unions. You will be responsible for reporting these
violations and must notify the proper departments and authorities. Once
they become knowledge to you then you must report them.  You have
created a hostile work environment for everyone. There will no one to
blame but your department for the upcoming events.
