December 18, 2020

Brothers and Sisters:

As we find ourselves amid what is historically the most dangerous
season of the year, I must unfortunately caution you of new additional
intensified dangers borne from the Federal Railroad Administrationís
(FRA) most recent Final Rulemaking. On Friday, December 11, 2020, the
FRA granted an extensive and exhaustive list of regulation changes, the
vast majority of which served to lower the bar of safety and increase
the profit margin for this nationís rail carriers. This is evidenced in
the no less than two dozen references of cost savings to the carriers as
a result of this rulemaking. Not only has the FRA once again vacated its
role as the countryís chief safety regulator, but it has also failed in
its own mission statement, vision, and purpose.

As you are aware, a known unsafe condition exists with the DB-10 brake
valves in cold weather conditions. In fact your Union, on December 15,
2019, petitioned the FRA to issue an Emergency Order that would
prioritize safety over productivity by requiring the replacement of the
defective valves and disallow the railroadsí attempts to apply stopgap
procedures that only camouflage and exacerbate the seriousness of the
situation. That petition was unfortunately denied by the FRA muzzling
our request for the safest course of action.

Due to the FRAís reckless action, rolling stock is now permitted to be
off-air for 24 hours before requiring a new brake inspection. This
means that the only true method of identifying the faulty brake valves
has been reduced immeasurably, if not eliminated altogether on certain
properties. As a result, the regularity of brake inspections has now
been reduced to a fraction of the previous standard, and, thus
defective brake valves will be permitted to remain in service longer
and be more apt to adversely affect a trainís braking capabilities.
Given the consequence of these faulty valves remaining in place is that
they render a trainís emergency brake feature inoperative, I am asking
all to please remain diligent in your daily duties and to take nothing
for granted. This includes railroad workarounds designed to mask flawed
brake valves like drawing the brake pipe pressure down to zero before
making a separation. Should a carrier official ask you to perform such
a task, please notify my office as soon as it is safe and proper to do
so, so that we may address it with the carrier and applicable
government agencies.

The railroads have historically had trouble maintaining an accurate
record of when a train or car(s) initiates its ďoff airĒ status (and
that was with the four-hour limit). I highly anticipate major
complications regarding the determination of actual time off air when
going on-duty or making a pick-up. If you feel as though you are being
instructed to move equipment that has been off air greater than
twenty-four hours, please report it to your supervisor and to my
office. Do not be insubordinate, but also do not allow the instance to
go unreported or undocumented. We will progress the report
accordingly.

In addition to the time off-air regulation, the FRA has also made
changes to regulations regarding single-car air brake tests,
end-of-train devices, helper service, brake maintenance, additional
brake-related items, utility employee duties, and various other rules
and/or processes.

It is clear the intent of these changes was not to improve safety, but
rather to widen the avenue in which railroads can operate without
oversight or guidance Ė a devastating scenario we just experienced with
the Boeing 737 Max. As such, please rest assured that our legal
department is currently in the process of filing a formal appeal and
petition of reconsideration to overturn this extremely dangerous and
egregious action. However, until a recourse can be achieved, it is on
all of us to have our brothersí and sistersí backs. It is clear that
the FRA and carriers do not.

Would you look at that link below? Three of the top 5 worst places to
work for were class 1 railroads with CSX being #5. I would argue that
is worse than Norfolk or UP but there's too many people still giving
CSX credit because their brains are mush. The money and retirement
isn't worth the torture one would have to endure unless they had less
than 5 to retire, and even that is a short time prison sentence. I
wonder when anyone in those unions will ever grow a set or the workers
will finally snap. Some people do enjoy cruel and unusual punishment
perhaps. Merry Christmas to all you idiots who still allow CSX to bend
you over with no lubrication and another year of abuse in 2021.

taking a big dump, or burning one in the air compressor room. Gotten by
like this for years, and making a good living. If managers say anything,

This is because they know damn well this virus numbers game is a bunch
of crap set up to get everyone going crazy and so damn scared they will
all line up and get a shot for something that every well person who has
not worn a mask, been sick or if was got over it since it showed up in
December. The damn flu did the same thing in the beginning and the
whole world wasnt shut down for it. If we want to take it all serious
then when the flu flares us again, shut down for the season and wear a
mask. Look at the real science. Quit looking at the trumped up death
numbers. People who were counted as dead from the virus because they
tested positive for the antibodies but died from a car wreck, pace
maker stops, fell off a roof and all the other blah blah we want our
money because we have a case of the corona in our hospital or nursing
home. If it was so damn bad as they claim, then you explain how this
country went from total insane nut wack job shut down and cleaning
everything under the sun along with wearing gloves everywhere you went
to the standards we have now. Look at the quarantine times now. Look at
the ESSENTIAL WORKER/SLAVE guide lines now. How retarded are people!!!!!
You get exposed at home, keep your butt at home for 14 days. You get
exposed to someone at work, keep coming in, check your temperature,
leave the life saving diaper on your face and KEEP WORKING! Look at
the hypocracy of that stupid idiotic guideline set up by the CDC and
the other morons that think the virus knows the difference between
someone at home or someone you sat next to all day that hacked and
coughed across your desk or lunch table and now you are testing
positive. Americans are just becoming air headed morons!

You installed them? Where do you look for them, If you put a washrag
over them that should block them right? That is if you can reach them.
If you take the detector cover off can you see them. Put some tape or
something over the camera. Can't come after you for tampering with
their smoke detector without proving you did it and that would only be
if they said they saw you do it or they check it every single time they
clean the room before the next person comes in. We all know these cheap
rate hotels we stay in wont ever do that! Lucky you get one that is
really clean! Like last poster said, it is illegal as hell and someone
needs their nads put in a vice grip for this one!

illegal!

As for the Avon detailment, hearing talk that RCO cobductor was order
to convert it to conventional and run without a license. We all knew
this crap would eventually happen! that's why the BLET didn't want

WHAT????

Let me get this straight. You have to work for 6 months straight
without taking any uncompensated days off in order to get points
removed from you records? I am guessing of course that you work on a
point system. I am also guessing from what I have heard about this kind
of system, when you get to a specific level you get called in and get a
pink slip warning. What I dont get is how the company can approve you
taking a personal business day and then turn around and make you start
all over earning credits towards cleaning up your point record. What
kind of crazy politics is this? I think if you talk to a labor law
lawyer, you could come up with something on this. Lord! What if you
spouse or child where to get seriously hurt and you couldn't come in
at the last moment. You are saying they will count this against you if
you call them and tell them what happened and they say it is okay to
take time off to do what is needed for the rest of the day? It is in
your union agreement to be able to do this? Something is not right
here. You better read your terms of agreement again. I just cant
believe that CSX would actually put something like this in their
attendance policy. That would be nothing more than a way to discourage
anyone from asking for a personal business day unless it was a severe
emergency and the punishment was less severe than what was happening. I
have to say this would be one serious ethic question to put to a lawyer!

Brothers

WAKE UP! If you think the PTC police are not watching, you better
think again. They are well aware of the illegal use of restricted mode
when you are not in switching moves. They are well aware of you not
adding cars that you are picking up on line of road. They are well
aware of cars being drug in under the radar on the main line that have
already been yarded. Be careful. Watch your butts. Lying and omitting
info into a Federally mandated program to scratch the companies back or
just because your too lazy to do the input or scared to put someone on
the spot to find the info will cost you your job. If you do it on your
own and no one has ordered you to do it, you are 100% LIABLE! If
anything goes down in a real bad way, you can kiss your job goodbye and
be responsible for all fines and possible jail time if incident level
warrants it. A fatality will send you packing and maybe up the river!
