Rule #1 -- Don't get hurt.

Safety is the first priority. Er, or is it the second, after money.... Or the third after getting the trains out....

Hey Robert:

There you go again...if you can't bedazzle us with brilliance,
befuddle us with bull shit. Just post some CFRs to back up your claim.
I'm sure there are a lot of things that can make signals fail
including EM pulses. That doesn't mean they do.

You know the Petersen boy was a minor? How do you know that? The mother
didn't mention it in her post and nothing was said in the NRC report.
You have either been in direct contact with the mother or you
said that because you got busted. You called the Ellerslie Tavern? So
what? Oh, by the way, the second you mentioned liquor and minor in the
same breath, they would have hung up on you. Just another
deflection...meaningless.

Here's one for you...September 8, 2011 was a Thursday. If the Petersen
boy were a minor, why wasn't he at home in bed at 0245
on a school night? Maybe he had graduated, been expelled or dropped
out...why wasn't he home sleeping on a work night? Maybe school
hadn't started yet. Perhaps the mother has some questions that need
directing to her.

Feel free to post as many video as you want...they all come off
YouTube and have been in the public domain for some time. Unless you
can prove they weren't edited, they too are meaningless.

Well NoMo'nLimbo I actually got up early. Late morning.

I tried calling the Ellerslie Tavern & Et Snack to find their hours of
operation and to see why they were serving liquor to a minor but the
phone was out of service. You have the number for the place to see if
they were even open on Sep 08, 2011?

http://ecfr.gpoaccess.gov/cgi/t/text/text-idx?c=ecfr&sid=5b4cdb0206c0db5c0d5a845ed9dde5c1&rgn=div5&view=text&node=49:4.1.1.1.28&idno=49

According to the FEDs there are all kinds of things that can make the
signals fail. You saying fog is one of them? Makes sense because the
moisture could make the poorly maintained ballast conduct better.

You check out Google maps? What is the place with the Pepsi sign with
the parking lot paved right up into the kill zone of the train? Also
this town being rail-locked it would be the only place to cross within
a couple miles. My kids did a lot of video games at that age ---

...First, it is absolutely impossible not to see, hear or feel a train
traveling at 43 MPH if you are on foot and not impaired even in thick
fog... I have plenty of video (with audio) that says your wrong on that
LIE. Glad I could help.

Good Morning Robert:

I see you were up late last night...there you go again, off on a
tangent. You let your problem reassert it's self. Better watch your
blood pressure.

First off, you weren't there, so you are basing your conclusions on
nothing more than your own personal anger at the carriers and the FRA.
A short post by a bereaved mother and an NRC report.

Secondly, you have made the statement that fog causes protection to
fail....where's your evidence. If that were the case then every
crossing gate from Panama City, FL to New Orleans, LA would have failed
multiple times over the last several weeks.

Never let the facts get in the way of the truth. First, it is
absolutely impossible not to see, hear or feel a train traveling at 43
MPH if you are on foot and not impaired even in thick fog. You made the
assertion the engineer missed the whistle post...based on what...fog?
You had better be careful or you might face a libel suit.
At 0245 there is a high probability that alcohol was involved on the
peds part. Guess what? The Ellerslie Tavern & Et Snack is just a block
north of the tracks. Sept. 8 was a Thursday...closing time is 0200 in
most States in that part of the country.

Keep looking though...but take your meds. It's a lot easier to make a
point when you view isn't obstructed by a personal agenda!

Actually NOMOLIERMFER a public rail crossing is not a trespasser. It's
a public road crossing. CSX put Code 1 on the report which was also a
lie and not code 8. Seems they tried but were caught lying. It was
foggy---the junk gates failed---train missed whistle posts.

41. Highway User
CODE:1
1. Went around the gate
3. Did not stop
2. Stopped and then proceeded

7. Went thru the gate

There is actually a sidewalk that is mid block in either Biloxi or
Gulfport, MS that has, had a gate. I'm sorry I don't remember which,
maybe someone on the NO&M will chime in.

Nothing good happens at 0245 around RR tracks. If they were standing in
the gauge, it was a suicide, if they were outside the gauge it could
have been an accident. Mrs. Petersen didn't say if alcohol was
involved, I'll bet there was. Your son and his girlfriend were
trespassing on private property...that's why no attorney will take the
case on a contingency fee basis, it's a loser. If you are willing to
hire the attorney outright, I'm sure one will gladly take it. That's
also why CSX won't pay anything.

I sorry for your loss. These incidents are much too common, I've never
seen a number but there are probably 3 or 4 of these a week across the
U.S.

Pines calling someone clueless about the railroads, now that is a joke.
Keep in mind this is coming from a guy who thinks a train needs a
steering wheel.. And what in the hell are sidewalk gates. Sonny boy,
are you on drugs?

Q35806 REPORTS STRIKING 2 PEDESTERIANS AT SHELLSBURG ROAD
CROSSING. BOTH VICTIMS WERE STANDING ON THE GRADE CROSSING PAVEMENT,
LOOKING WEST DIRECTLY TOWARD THE EAST BOUND TRAIN.

Suicide,, plain and simple. Here is your question? What were they
doing in the middle of the tracks? Where they deaf? Where they drunk?
Where they blind?

Ms Peterson ---Check around on lawyers. Most are clueless when it comes
to railroads.

Looks like CSX lied initially as usual. Two o'clock in the morning
---fog. Poor lighting. No sidewalk arms. Greedy railroad doesn't slow
down.

My son and his girlfriend were hit and killed by a CSX train September
8, 2011. I can't get anyone from the railroad to answer any of my
questions about the accident. It seems as if no attorneys want to go
against the railroad also. I just want to know what really happened
and if CSX is responsible financially especially for the cost of the
funeral and burial. The accident was first ruled a suicide, but C3I
Detectives, after reviewing the video from the train, said that it was
definitly an accident. Why can't I get any answers or the truth about
what really happened that night?

Good morning Robert:

I thought for a moment you had turned a corner...but with your last
post, you proved me wrong.

I, along with my fellow Suckers are extremely disappointed. However,
rest assured, your friends, the carriers are delighted.

You were doing good...until you let your personal feelings reassert
control. If you had just been able to resist inserting your opinions in
your last post.

Remember...admitting to yourself that you have a problem, is the first
step in overcoming it.

Concentrate on the issue...grade crossing safety and keep your personal
feelings aside!

RE:Warning signals were deactivated when train hit SUV in 2010
accident.

The Federal Rail-bought Association NEVER goes out for a single
fatality train collision unless the railroad needs a good cover story
because the real witnesses can't be lost.

http://www.chicagotribune.com/news/local/breaking/chi-6-million-settlement-in-train-death-of-dance-teacher-20120313,0,1434945.story
In the video the gates were down and signals flashing right after
---The magic crossing fairy turn the deactivated signals back on?
Pretty pathetic when OUR investigating cops don't even know what kind
of train was involved.

The railroad signal maintenance people would learn from day 1 to have
road guards out while the signals were being worked on. The train would
of had a slow order also. So the signal maintainer just pulled off the
road guards and left? I don't think so.

http://www.icc.illinois.gov/railroad/crossing.aspx?dotId=289680Y

Docket History --- Nature of Case:
Stipulated Agreement regarding improving public safety by the
installation of digital remote monitors at 227 public highway-rail
grade crossings of the Illinois Central Railroad Company’s tracks, and
replacement of the existing incandescent signal heads with light
emitting diode (LED) signal heads at 133 public highway-rail grade
crossings of the Company’s tracks in Illinois.

Documents ---STIP Total ---$1,380,150. The trick here was to pump a
million bucks in the railroads pocket to keep signals from going in at
passive crossings saving the railroad the yearly maintenance costs
where the mickey mouse signs are.

Remote monitors TELL the railroad when the signals aren't working. If
the Feds weren't dirty this signal would go out to the local police
also.

I see you finally found a grade crossing accident that you can honestly
blame on the carrier...in this case the CN/IC.

There is no doubt about it, pure negligence and the carrier knew it!

Old heads,

Got a question for you seeing you have seen and heard it all.

Why would a dispatcher tell a crew(sitting out of yard waiting to come
in) to write down a 6 digit number with no reason why or what its for.
Didnt match anything in disp bulletins and wasnt a car number in their
train. Other train crews heard it too and were wondering why.
Dispatcher never did tell them what it was for just ordered them to do
it. Got any ideas? We are all baffled.

Just what in the hell was this guy thinking. Texting and standing in

one of your family members would do... DUH!!!!

MENLO PARK, Calif.—An executive with the PayPal online payment service
has been struck and killed by a commuter train in Northern California.

San Mateo County coroner's investigators on Sunday identified the
victim as 39-year-old Eric Salvatierra of Palo Alto.

The San Francisco Chronicle ( http://bit.ly/yCmeRK) says Salvatierra
was killed by a Caltrain on Friday morning in Menlo Park.

Commuter rail officials say he was standing on the tracks when he was
hit by a northbound train. The death is being investigated.

Salvatierra was a vice president of online payment service PayPal,
where he's worked for about five years.
