    Anyone who's worked around the clock has either seen, or experienced first-hand, the inevitable effects of sleep deprivation. Maybe it was you, maybe it was the jitney driver, maybe it was....

    The real fun is when someone tries to explain to the crew-caller that they are too tired to go to work.

Exfed The rumor (yes, rumor) is that the yard master did not have
bulletins to operate on the mainline outside the yard, and no hours of
service reporting was generated either.

AVON IDIOT


FRA LAW 240.231-READ IT. You obviously do not know the law. An engineer
who has been previously qualified on any territory is not restricted
from running on said territory as long as he/she doesn't not violate
the following actions.

Pilots are not required for engineers who previous qualifications have
expired if:
If territory has less than a 1% grade over a continuous 3 miles AND

(1) The track is other than main track OR
(2)The maximum distance the train is operated does not exceed one mile
OR
(3)The maximum authorized speed does not exceed 20 mph OR
(4)Does not exceed or violate restricted speed rules.

So what Federal rule did this licensed YM or TM violate. There is no
federal law that prohibits a YM from working as an engineer in
co-mingled service as long as he/she reports it and does not violate
hours of service laws. So what laws were broken? It sounds like the
only thing that was violated was your union agreements which the
FRA/Feds don't care one thing about unless the act did violate a
federal law. Union agreements are of no concern to them nor are they in
their jurisdiction to enforce.

You came on here and posted names to out someone. Now, tell everyone
what federal law was violated. If the FRA got involved then something
more serious had to gone down. Was the engineers license expired? Did
he work past 12 hours? Did he run over 20 mph? 
I suggest you and all your fellow employees buy the latest FRA codes of
law and keep them handy. This way you don't look like idiots before you
come on here and post misinformation or false info.

And another thing, you better learn your operating rules. Most of you
have no idea what the difference is between being qualified and CURRENT
on your territory. Once you have been qualified and are shown as
educated/trained on the territory you are responsible for keeping
yourself current. Unless you did not have the seniority to make a move
to a particular job after you were QUALIFIED to keep yourself current
then it is your fault that you are NOT! This is not restricting your
seniority rights. You can bump on the job and then go back to your
previous job if you can still hold it. This does not restrict your
seniority. If you think for one moment the company can not go back a
check your history and the history of who was on the job, you are sadly
mistaken. If anyone was on that job who was senior to you and you
didn't get on it to stay current(12/24 months) it is ALL YOUR FAULT!
It is a joke how many of you whine and cry, "I don't like that job!
I'm not getting on that just to stay current!"  Then you scream you
want a pilot when you get stuck on it later down the road. Your not
entitled to it if you didn't keep yourself current when you could.
What you are subject to is being charged with violating an operating
rule!
READ OPERATING RULE 110.2!!!!
No where does it say that you don't have to stay current on the jobs
WHERE YOU ARE SUBJECT TO WORK if you don't like them!  BOO HOO!

It's time to grow up. It's time to read your rules. It's time to do
your homework. Before you come on here and spout off rumors or
conjecture learn the rules and the laws.
ONCE AGAIN!  Once you are qualified you are qualified. It is up to you
to stay current per your operating rules!

Now, what federal law did the YM and the TM violate!
